NLRB Board Member - ‘The First Black Woman To Serve As Its Chair’ - Who Was Fired By Trump ‘Loses Out On Supreme Court Review’

Kelsey Reichmann at The Courthouse News Service reports the U.S. Supreme Court dodged a fight over the limits of President Donald Trump’s executive authority, declining to review his firing of a Member of the National Labor Relations Board (NLRB). Despite the High Court’s expansive ruling curtailing the independence of executive agencies last term, Gwynne Wilcox challenged her termination from the NLRB. She had urged the Justices to review her appeal, claiming the Agency fell outside the bounds of Presidential power. Wilcox, the first Black Woman to serve on the NLRB and as its Chair, was fired in an e-mail a week after Trump retook office in 2025. Trump claimed he terminated Wilcox because he needed a Board of his choosing to carry out the Administration’s policies. She was initially reinstated by the D.C. Circuit until the Supreme Court blocked the decision at Trump’s request. Wilcox said she remained committed to protecting principles that allow Board Members to serve the public fairly despite the Court’s decision - and added in a released statement: “I’m disappointed the Supreme Court has declined to hear this case, not only for myself, but also for the Workers and employers who rely on the National Labor Relations Board to resolve Labor disputes impartially and free from political pressure. This does not mean our fight for justice is over.”
