NYC ‘Ordered To Reinstate Workers Fired For Vaccine Refusal’

Bloomberg Law reports New York City has been ordered to reinstate a group of Sanitation Workers who were fired for refusing to get a COVID-19 vaccine after a State Court Judge ruled the mandate was unlawful.  The Judge said the City’s Health Commissioner has the authority to issue public health mandates, but can’t create a new condition of employment for Municipal Employees, can’t prohibit them from reporting to work and can’t terminate Employees.

Mandatory immunizations/vaccines as a condition of employment are not new, but are and have been the rule. There are now a number of studies of scientific data, led by John Hopkins, that go from June 2021 to July 2022, on hospitalizations and deaths due to COVID. June 2021 is used because by that date anyone medically able to get the COVID vaccine (which is free) could have easily been vaccinated. The data establishes beyond doubt that States with the lowest vaccination rates had the highest hospitalization and death rates - and it was not even close. Being a safety threat to self or others is NOT a new condition of employment for any workplace. The only bigger threat to us than COVID in the last several years is the contagion of MAGA and anti-vax stupidity and bigotry. This disease has also clearly taken hold in the Judiciary.
