(ALBANY, NEW YORK) – The New York State AFL-CIO is praising the signing of the New York HERO Act, which now requires businesses to have enforceable Safety Standards to prevent the further spread of Coronavirus and other airborne diseases.
On Wednesday (May 5th), New York State Senate Deputy Leader Michael Gianaris and Assembly Member Karines Reyes announced Governor Andrew Cuomo had signed the New York HERO Act (S.1034-B/A.2681-B).
The NY HERO Act, or the New York Health and Essential Rights Act, requires the Departments of Labor and Health to implement enforceable minimum standards for workplace safety.
The regulations must include protocols on testing, PPE, social distancing, hand hygiene, disinfection, and engineering controls.
In addition, Workers are provided a direct role in monitoring and reporting violations through Workplace Health and Safety Committees and Employees would be protected from retaliation for utilizing their rights under the law.
State AFL-CIO President Mario Cilento issued the following statement on the passage of the New York State HERO Act:
Every day Working People have gone above and beyond to carry us through the pandemic and for too many of them the cost has been their own health and even death. The least we can do as a state is help ensure that their employers take every reasonable measure necessary to keep them safe on the job. This pandemic has exposed the weaknesses in workplace safety. The NY HERO Act changes that by ensuring Workers have a safe working environment now and just as important, for future communicable disease events. It establishes vital standards related to workplace protocols, including providing proper safety and Personal Protective Equipment (PPE), as well as proper ventilation and social distancing requirements to protect Workers and the public. We thank the Democratic Majorities in both houses and the Bill sponsors, Senator Mike Gianaris and Assembly Member Karines Reyes for making workplace health and safety a priority, particularly now during the pandemic.”
Senate Deputy Leader Gianaris said: “Too many Workers have already sacrificed their health for our community’s benefit. The New York HERO Act will honor their efforts by giving Workers the tools to protect themselves while on the job.
